So, here’s my take: It’s not the fans who are violating the DMCA, but the hosting sites, since they are the ones making money from our fan vids. I am with EMI on this:

EMI’s suit will likely revolve around two legal issues. First, are video-sharing sites — which organize, categorize and profit from user-uploaded copyrighted content — liable for copyright infringement? While the Digital Millennium Copyright Act includes “safe harbor” provisions for sites that promptly remove videos upon receipt of takedown notices from content owners, copyright owners claim that the DMCA, enacted years before video-sharing sites even existed, was never intended to protect sites that built businesses around rampant, unlicensed use of others’ intellectual property, especially when they encourage users to upload copyrighted content. (EMI also alleges that Vimeo itself uploaded videos containing its music, activity that isn’t covered by DMCA safe harbors.)

The suit however, does not cover the fanvids that are created, by say, fans of The Colbert Report, The Daily Show or even, the O’Reilly Factor (Disclaimer: I have made fanvids for all three shows. Hey, even O’Reilly needs…. uh… uhm….) But, since we the creators of these videos are not the ones profiting….

If you haven’t heard about the popular uprising in Iran following a bad attempt to rig the election, you must be a member of the Limbaugh Party as evidenced by this asshat of a tweet into the coverage via twitter:

Yes, just had to shit in the bed. The little asshole wouldn’t know “popular uprising if it severed his dick. In fact, it’s being popularly ignored by the G(n)OP, since it doesn’t serve their agenda for an air strike on Iran’s nuclear facilities. They, like Edward Teller, don’t give a rat’s ass about the people who would die as a result of such an action. Only about the “result”… which means all out war on Israel, and, their aim of the End Times.

As I watch the unfolding of events tweet by tweet, I am struck by how the Iranian people are more participatory in politics than we Americans. To us, it’s a chore, a hardship to serve on a jury or even to vote. I am an American and a Jew, and to the people of Iran I say “Allah-OAkhbar” God is Great and may He bless you with a true and just outcome to your aspirations and a lasting Peace between all People in the region Shalom/Salaam/Peace

Taken at the Colorado Bund Rally in Denver to protest the stimulus. Since “Colorado says NO to Obama”  I presume, that when stimpak money arrives for roads, schools and other infrastructure improvements, these “Patriots” complain about Mexicans doing the construction work, but they have already said, in this protest, that the work of “improving the infrastructure of the State of Colorado” is beneath them.
